|
As defined in the Standards of Judicial Administration,
section 19, complex litigation cases are "those cases that
require specialized management to avoid placing unnecessary
burdens on the Court or the litigants. Complex Litigation
is not capable of precise definition and may involve, for
example, multiple related cases, extensive pretrial activity,
extended trial times, difficult or novel issues, and post
judgment judicial supervision, or may concern special categories
such as class actions; however no particular criterion is
controlling and each situation must be examined separately".

At the first CMC, to be held within 120 days of filing
the initial complaint (see local rule Chapter 3), the court
shall make the determination as to whether the matter meets
the complex litigation status. Upon the court's finding
of exemption from ECT, the court shall ensure that the case
is progressing to a disposition in a timely fashion. The
court may do one or more of the following, including, but
not limited to, establishing a regularly monitored program,
appointing a Special Master or administering the matter
in order to promote the efficient administration of justice
in accordance with CRC and the Standards of Judicial Administration.
