CIVIL TRIALS

RULE 6.1 JURY TRIALS

(a) Jury Deposits: For all civil matters scheduled for a jury trial, other than unlawful detainer actions, the first day's jury deposit of $100 must be received by the Clerk's Office twenty-five (25) days prior to trial. In unlawful detainer actions, the first day's jury deposit of $100 must be received by the Clerk's Office five (5) days prior to trial.
   
(b) Jury Instructions: Each party must submit two copies of the proposed jury instructions no later than the second day of trial. Such instructions must comply with CRC, Rule 229.
   
(c) Motions in Limine: All motions in-limine must be in writing. Each motion and response shall be filed no later than the first day of trial.
   
(d) Demand for Jury Trial: All civil cases set for trial in which there is an entitlement to a jury will be deemed to have a jury demand made by plaintiff absent a waiver in writing or in open court. If no waiver is made, plaintiff shall be responsible for the jury deposit. If plaintiff waives a jury, either by actual waiver or by failure to deposit the correct jury fees as set out in (a), any other party may demand a jury and be responsible for the jury deposit consistent with Code of Civil Procedure section 631(b).

RULE 6.2 COURT TRIALS

The court may specially set all matters subject to a court trial. A court trial is defined as a matter lasting more than one hour without a jury.
